Nella seduta dello scorso 20 febbraio, la Commissione consultiva del Consiglio Nazionale Forense, ha adottato un parere in merito alla possibile compatibilità tra l’attività di amministratore di condominio e la professione forense, tenendo in considerazione il nuovo ordinamento professionale forense (Legge n. 247/2012) e la modifica della disciplina del condominio degli edifici (Legge n. 220/2012).
Nel testo del parere, si dice espressamente che “l’attività di amministratore di condominio si riduce, alla fine, all’esercizio di un mandato con rappresentanza conferito da persone fisiche, in nome e per conto delle quali egli agisce e l’esecuzione di mandati, consistenti nel compimento di attività giuridica per conto ed (eventualmente) in nome altrui è esattamente uno dei possibili modi di svolgimento dell’attività professionale forense sicché la circostanza che essa sia svolta con continuità non aggiunge né toglie nulla alla sua legittimità di fondo quale espressione, appunto, di esercizio della professione“.
